Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Tshongla (“we”, “us”) at tshongla.com (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least the minimum age required by your local law to use the Service. If you are using the Service on behalf of an organization, you represent you have authority to bind that organization.

2. Accounts

• You are responsible for your account and maintaining the confidentiality of login credentials.
• You must provide accurate information and keep it updated.
• We may suspend or terminate accounts that violate these Terms or abuse the Service.

3. Marketplace / third-party shops

Tshongla may display products, services, and shop information provided by independent third parties (“Shops”). Shops are responsible for the accuracy of their listings, pricing, availability, and fulfillment unless we explicitly state otherwise.

When you interact with a Shop, you may be communicating directly with that Shop. Tshongla is not responsible for disputes between users and Shops, but we may help facilitate resolution at our discretion.

4. User content

If you submit content (e.g., shop listings, images, descriptions, reviews/feedback), you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for formatting), display, and distribute that content for operating and promoting the Service.

You represent you have the rights to upload content and that it does not violate laws or third-party rights.

5. Prohibited conduct

• Do not use the Service for unlawful, harmful, fraudulent, or abusive purposes.
• Do not attempt to gain unauthorized access to accounts, systems, or data.
• Do not upload malware, spam, or infringing content.
• Do not scrape the Service excessively or interfere with normal operation.

6. Intellectual property

The Service, including branding, design, and software, is owned by Tshongla or its licensors and is protected by applicable laws. You may not copy or reverse engineer the Service except as permitted by law.

7. Disclaimer of warranties

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the maximum extent permitted by law, Tshongla will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless Tshongla from claims, damages, liabilities, and expenses arising from your use of the Service, your content, or your violation of these Terms.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service if you violate these Terms or if we must do so for security or legal reasons.

11. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. We will update the “Last updated” date above. Continued use after changes means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Bhutan, without regard to conflict of law principles.
